Sky Stack — Tower Block Game by Gigabyte LLC

Welcome to Sky Stack - Tower Block Game ("Sky Stack", "the Game", "our Game"). These Terms of Service ("Terms") govern your access to and use of the Sky Stack mobile application, including all related content, features, and services provided by Gigabyte LLC ("we", "us", "our", "the Company").

Please read these Terms carefully before using the Game. By downloading, installing, or using Sky Stack, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, accessing, or using Sky Stack, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must immediately cease using the Game and uninstall it from your device.

We reserve the right to modify these Terms at any time. Changes will be effective when posted within the Game or on our website. Your continued use of Sky Stack after changes have been posted constitutes your acceptance of the updated Terms.

2. Eligibility

Sky Stack is rated 4+ and is designed to be enjoyed by players of all ages. There are no age restrictions for playing the Game.

If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents and guardians are responsible for supervising their children's use of the Game, including any in-app purchases.

By using the Game, you represent and warrant that you have the legal capacity to enter into a binding agreement in your jurisdiction, or that a parent or guardian has done so on your behalf.

3. License Grant

Subject to your compliance with these Terms, Gigabyte LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Sky Stack on compatible Apple devices that you own or control, solely for your personal, non-commercial entertainment purposes.

This license does not grant you any right, title, or interest in or to the Game beyond the limited right to use it as described herein. You may not:

• Copy, modify, distribute, sell, or lease any part of the Game
• Reverse engineer, decompile, or disassemble the Game
• Use the Game for any commercial purpose
• Remove, alter, or obscure any proprietary notices in the Game
• Transfer your license to another person or entity

4. User Accounts

Sky Stack offers the following account options:

• Apple Sign-In: You may sign in using your Apple ID to enable features such as cloud save, cross-device syncing, and Game Center leaderboards. Your Apple ID information is handled in accordance with Apple's privacy policies and our Privacy Policy.
• Guest Accounts: You may play Sky Stack without creating an account. Guest accounts store progress locally on your device. Please note that progress on guest accounts may be lost if you uninstall the Game, reset your device, or switch devices.

You are responsible for maintaining the security of your account and any activity that occurs under your account. We encourage you to use Apple Sign-In to protect your game progress.

5. In-App Purchases

Sky Stack offers optional in-app purchases, including but not limited to:

• Virtual Coins: In-game currency that can be used to unlock cosmetic items, block skins, and other content
• Remove Ads: A one-time purchase to permanently remove advertisements from the Game
• Cosmetic Items: Block skins, themes, visual effects, and other customization options
• Season Pass: Timed premium content access with exclusive rewards and challenges

Prices for in-app purchases are displayed in your local currency within the Game and may vary by region. We reserve the right to change pricing at any time without prior notice.

6. Virtual Currency and Items

All virtual currency (coins), items, skins, and other digital content within Sky Stack are licensed, not sold. You receive a limited, personal, non-transferable, revocable license to use virtual items within the Game, subject to these Terms.

Virtual currency and items:

• Have no real-world monetary value and cannot be exchanged for real money, goods, or services
• Cannot be traded, sold, or transferred to other players or outside the Game
• May be modified, updated, or removed at our discretion for balancing, technical, or other reasons
• Will be forfeited if your account is terminated due to violation of these Terms

7. Game Modes

Sky Stack currently offers multiple game modes including Classic, Time Attack, Zen, and Precision. We reserve the right to add, modify, remove, or rebalance game modes at any time to improve the overall game experience, address balance issues, or introduce new content.

Changes to game modes may affect gameplay mechanics, scoring systems, difficulty levels, and reward structures. We will endeavor to communicate significant changes through in-game notifications or updates.

8. User Conduct

When using Sky Stack, you agree not to:

• Cheat: Use unauthorized software, hacks, bots, scripts, or exploits to gain an unfair advantage
• Exploit bugs: Intentionally exploit glitches, bugs, or unintended game mechanics. We encourage responsible disclosure of bugs to our support team
• Manipulate scores: Submit fraudulent, manipulated, or artificially inflated scores to leaderboards
• Harass others: Engage in harassment, abuse, or threatening behavior toward other players or our staff
• Interfere: Attempt to disrupt, damage, or interfere with the Game's servers, networks, or infrastructure
• Impersonate: Impersonate any person or entity, or falsely represent your affiliation with any person or entity

Violation of these conduct rules may result in temporary or permanent suspension of your access to the Game, removal of your scores from leaderboards, and forfeiture of virtual currency and items.

9. Leaderboards and Social Features

Sky Stack includes leaderboards powered by Apple Game Center. Participation in leaderboards and social features is opt-in and subject to the following:

• Leaderboard participation requires Game Center sign-in
• Your Game Center display name and scores will be visible to other players on the leaderboard
• We reserve the right to remove fraudulent, manipulated, or suspicious scores from leaderboards without prior notice
• We may reset leaderboards periodically for seasonal events or to maintain competitive integrity
• We are not responsible for the accuracy of Game Center rankings or any disputes arising from leaderboard placement

10. Intellectual Property

All content within Sky Stack, including but not limited to graphics, artwork, animations, sound effects, music, text, game mechanics, code, user interface design, block skins, and the Sky Stack brand identity, is the exclusive property of Gigabyte LLC and is protected by copyright, trademark, and other intellectual property laws.

The Sky Stack name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Gigabyte LLC. You may not use such marks without our prior written permission.

You may share screenshots and gameplay recordings of Sky Stack on social media and content platforms for non-commercial purposes, provided you credit Sky Stack and do not misrepresent the Game.

11. Advertisements

Sky Stack displays advertisements through third-party ad networks. Advertisements will be shown during natural gameplay breaks, such as between game sessions.

If you purchase the "Remove Ads" option, all non-voluntary advertisements will be permanently removed from your Game experience. Note that optional rewarded advertisements (which provide in-game bonuses) may still be available for you to watch voluntarily.

Third-party advertisers may collect certain data as described in our Privacy Policy. We are not responsible for the content, accuracy, or opinions expressed in third-party advertisements.

12. Availability and Modifications

We reserve the right to update, modify, suspend, or discontinue Sky Stack (or any part thereof) at any time, with or without notice. This includes the right to:

• Release updates that add new features, fix bugs, or change gameplay
• Modify or remove game content, including virtual items and game modes
• Temporarily suspend the Game for maintenance or technical issues
• Permanently discontinue the Game

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Game. We recommend keeping automatic updates enabled to ensure the best experience.

13. Disclaimers

Sky Stack is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The Game will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Game will be accurate or reliable
• Any defects in the Game will be corrected
• The Game will be compatible with all devices or operating system versions

You use Sky Stack at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Gigabyte LLC, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Game
• Any conduct or content of any third party within the Game
• Any content obtained from the Game
• Unauthorized access, use, or alteration of your account or data
• Loss of virtual currency, items, or game progress

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Game shall be resolved exclusively in the courts located in Sweden. You consent to the personal jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
